Terms of Service

These Terms of Service ("Terms") govern access to and use of Mulligans Menu, including our website, ordering tools, course dashboard, driver console, QR-code ordering pages, SMS notifications, and related services (collectively, the "Service").

1. Who We Are

Mulligans Menu provides software tools that help participating golf courses offer on-course food and beverage ordering. The Service allows golfers to submit orders, allows authorized course staff and beverage cart drivers to view and fulfill those orders, and allows courses to manage menus, drivers, QR codes, orders, and billing information.

Mulligans Menu does not operate golf courses, prepare food or beverages, employ beverage cart drivers, sell alcohol, process golfer payments, or complete point-of-sale transactions between golfers and courses.

2. Acceptance of These Terms

By accessing or using the Service, creating an account, signing into a dashboard, starting a driver shift, submitting an order, scanning a course QR code, or otherwise using Mulligans Menu, you agree to these Terms.

If you use the Service on behalf of a golf course, club, company, or other organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

3. Users of the Service

The Service may be used by participating golf courses and their authorized administrators, authorized beverage cart drivers and course staff, golfers placing on-course food or beverage orders, and Mulligans Menu personnel supporting the Service.

Each user is responsible for using the Service lawfully and only for its intended operational purpose.

4. Course Responsibilities

Mulligans Menu is not responsible for a course's food or beverage quality, product availability, pricing accuracy, tax treatment, alcohol compliance, staff conduct, order fulfillment, or golfer payment collection.

  • Maintaining accurate course, contact, menu, price, service-hour, driver, and availability information
  • Ensuring that authorized staff and drivers are properly trained
  • Fulfilling, rejecting, or managing orders submitted through the Service
  • Completing golfer payment through the course's normal point-of-sale process
  • Complying with all laws and regulations that apply to food, beverage, alcohol, tax, pricing, service, employment, safety, and golf course operations
  • Ensuring that alcohol is sold and served only by properly authorized personnel and only to eligible customers
  • Placing and maintaining QR codes, signs, and other course-facing materials
  • Keeping account credentials secure
  • Paying Mulligans Menu fees when due

5. Golfer Orders

Golfers may use the Service to submit food and beverage orders to participating courses. Orders may include selected menu items, phone number, current hole, group description, and location information used to help the beverage cart locate the golfer.

Submitting an order through Mulligans Menu does not complete payment. Payment is handled directly between the golfer and the course through the course's existing point-of-sale process.

Menu prices, taxes, service fees, product availability, and final totals may vary based on course policies, local tax rules, product substitutions, and the course's point-of-sale system.

Courses may accept, decline, cancel, or be unable to fulfill an order due to service hours, staffing, weather, inventory, operational issues, legal restrictions, or golfer availability.

6. Payments and Billing

Mulligans Menu does not process golfer payments and does not collect card information from golfers for food or beverage purchases.

Unless otherwise agreed in writing, Mulligans Menu charges participating courses a service fee equal to 10% of each completed order submitted through the Service, capped at $1.50 per order.

Courses may choose to add a convenience, delivery, or service fee to their own menu or point-of-sale process, subject to applicable law and course policy.

Mulligans Menu may invoice participating courses based on completed order records. Courses are responsible for reviewing invoices promptly and paying all undisputed amounts when due.

If a course fails to pay amounts owed, Mulligans Menu may suspend or restrict access to the Service until the account is brought current.

7. Order Records, Adjustments, and Disputes

Order records may be used for operational history, reporting, and billing. Courses are responsible for marking orders accurately as completed, canceled, or otherwise resolved.

If a course believes an order was marked completed in error, was not fulfilled, was duplicated, or should not be billable, the course should contact Mulligans Menu support promptly with the order details.

Mulligans Menu may review order records, timestamps, driver activity, and available system logs to determine whether an adjustment is appropriate. Mulligans Menu may approve or deny invoice adjustments in its reasonable discretion.

Courses may not manipulate order status, create false cancellations, or misuse the Service to avoid valid fees.

8. Driver Use and SMS Notifications

Authorized beverage cart drivers and course staff may receive operational SMS messages related to the Service. These messages may include order alerts, order details, delivery location information, customer contact information, shift-related information, and links to the driver console.

Message frequency varies based on order volume and shift activity. Message and data rates may apply.

Consent to receive SMS messages is not a condition of purchasing goods or services from Mulligans Menu. Drivers and staff may opt out of SMS messages at any time by replying STOP. After replying STOP, you may receive a confirmation message and will no longer receive SMS notifications unless you opt in again. For help, reply HELP or contact us at mulliganmenu@gmail.com.

If a driver opts out of SMS messages, order fulfillment may still require use of the driver console or other course-provided communication methods.

9. Location Information

The Service uses location information to help beverage cart drivers find golfers and to support order fulfillment. Golfers may be asked to share location information when placing or tracking an order. Drivers may share location information while on shift.

Location information should be used only for authorized course operations and order fulfillment. Course staff and drivers may not use location information for harassment, surveillance, marketing, or unrelated purposes.

10. Account Security

Courses, administrators, drivers, and other authorized users are responsible for keeping login credentials secure and for all activity under their accounts or course credentials.

Users must notify Mulligans Menu promptly if they suspect unauthorized access or misuse of the Service.

11. Acceptable Use

  • Use the Service for unlawful, fraudulent, abusive, or unauthorized purposes
  • Access another course's account or data without authorization
  • Interfere with or disrupt the Service
  • Attempt to reverse engineer, scrape, overload, attack, or compromise the Service
  • Submit false, misleading, or abusive orders
  • Misuse golfer, driver, staff, course, order, phone, or location information
  • Use the Service to violate alcohol, tax, employment, safety, privacy, or communications laws

12. Availability and Changes

Mulligans Menu may update, improve, suspend, or discontinue portions of the Service from time to time. We may also perform maintenance or restrict access when needed to protect security, reliability, or lawful operation.

We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

13. Intellectual Property

Mulligans Menu and its software, website, branding, designs, text, graphics, workflows, and related materials are owned by Mulligans Menu or its licensors and are protected by applicable intellectual property laws.

Courses may use course-specific QR codes, setup materials, and dashboard tools only for authorized use of the Service.

14. Privacy

Use of the Service is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information.

15. Third-Party Services

The Service may rely on third-party providers for hosting, database storage, maps, SMS delivery, analytics, payments, or other operational services. Mulligans Menu is not responsible for third-party services except as required by applicable law.

16. No Revenue Guarantee

Mulligans Menu is designed to help courses offer more convenient on-course ordering. We do not guarantee increased sales, order volume, golfer adoption, revenue, profitability, or business results.

17. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

18. Limitation of Liability

To the maximum extent permitted by law, Mulligans Menu will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, service interruption, or business interruption arising from or related to the Service.

To the maximum extent permitted by law, Mulligans Menu's total liability for any claim arising from or related to the Service will not exceed the amounts paid by the applicable course to Mulligans Menu during the three months before the event giving rise to the claim, or $100 if no amounts were paid.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply.

19. Indemnification

To the maximum extent permitted by law, participating courses agree to defend, indemnify, and hold harmless Mulligans Menu from claims, damages, liabilities, losses, costs, and expenses arising from or related to the above.

  • The course's operation, products, staff, drivers, or fulfillment of orders
  • Food, beverage, alcohol, tax, employment, safety, or point-of-sale compliance
  • Course-provided menu information, pricing, service fees, QR placement, or customer communications
  • Misuse of the Service by course administrators, staff, or drivers
  • The course's breach of these Terms

20. Termination or Suspension

Mulligans Menu may suspend or terminate access to the Service if a user or course violates these Terms, creates security or operational risk, fails to pay amounts owed, or uses the Service unlawfully or abusively.

Courses may stop using the Service by removing QR codes, discontinuing dashboard use, and contacting Mulligans Menu regarding account closure and any outstanding amounts.

21. Governing Law

These Terms are governed by applicable law. Specific governing law and venue terms may be updated as Mulligans Menu finalizes its legal operating structure.

22. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date. Continued use of the Service after changes become effective means you accept the updated Terms.
